1. About BoxerView

BoxerView is software designed to communicate with compatible vehicles and diagnostic hardware to display, record, organize, and analyze vehicle and electronic control unit (“ECU”) information.

Depending on the vehicle, ECU, connected adapter, and version of BoxerView, features may include vehicle identification, ECU identification, live diagnostic measurements, data logging, compatibility detection, ECU fingerprinting, validation tools, and related diagnostic functions.

BoxerView is intended to provide informational and diagnostic assistance only. It is not a substitute for inspection, diagnosis, repair, or advice from a qualified automotive professional.

2. Vehicle safety

You are responsible for operating and maintaining your vehicle safely.

Do not interact with BoxerView while driving. If BoxerView is used in a moving vehicle, a passenger should operate the application, or the application should be configured before the vehicle begins moving. You must obey all applicable traffic and safety laws.

Never rely on BoxerView to determine whether a vehicle is safe to drive. If you believe your vehicle may have a mechanical, electrical, fuel, braking, steering, engine-management, or other safety-related problem, stop using the vehicle when appropriate and have it inspected by a qualified professional.

3. Diagnostic information is not guaranteed

Vehicle diagnostic information can be affected by factors outside the control of BoxerView or EMJAK Technologies, including vehicle condition, ECU software and calibration, aftermarket modifications, sensors and wiring, diagnostic adapters, communication errors, unsupported ECU variants, incorrect or incomplete vehicle definitions, network or protocol behavior, software defects, and data conversion or interpretation errors.

We do not guarantee that information displayed, calculated, recorded, identified, or interpreted by BoxerView is complete, accurate, current, or suitable for diagnosing a particular vehicle condition. A reading that appears normal does not guarantee that a vehicle or component is operating correctly, and an abnormal reading does not necessarily mean that a component has failed.

4. Vehicle modifications and tuning

BoxerView may display information that users choose to use when diagnosing, modifying, repairing, or tuning a vehicle. EMJAK Technologies does not control and is not responsible for modifications, tuning decisions, repairs, adjustments, or other actions you perform based on information obtained through BoxerView.

Modifying or tuning a vehicle can result in engine damage, drivetrain damage, emissions violations, warranty issues, reduced reliability, personal injury, property damage, or other consequences. You assume responsibility for decisions you make regarding your vehicle. BoxerView should not be treated as authorization or instruction to modify any vehicle or ECU.

5. Read-only and diagnostic functions

Certain BoxerView features may be described as “read-only,” “monitoring,” “logging,” “diagnostic,” or similar terms. These descriptions refer to the intended operation of the applicable BoxerView feature and are not a guarantee that communication with every vehicle, ECU, adapter, or third-party device is risk-free.

Automotive diagnostic communication involves hardware and systems outside the control of EMJAK Technologies. You assume the risks associated with connecting diagnostic equipment or software to your vehicle.

6. Compatibility

BoxerView does not guarantee compatibility with every vehicle, ECU, calibration, diagnostic adapter, operating-system version, or hardware configuration. Compatibility information may change as BoxerView is developed.

A vehicle being recognized by BoxerView does not guarantee that every parameter or feature is supported or accurate. EMJAK Technologies may add, modify, restrict, or discontinue support for particular vehicles, ECUs, adapters, parameters, or features at any time.

7. Third-party hardware and software

BoxerView may communicate with or rely upon products and services supplied by third parties, including diagnostic adapters, vehicle interfaces, operating systems, and Apple services. Unless expressly stated otherwise, third-party products are not manufactured, controlled, or warranted by EMJAK Technologies.

Use of a third-party product may also be subject to that provider’s terms, warranties, and privacy practices. EMJAK Technologies is not responsible for failures, incompatibilities, damage, data loss, or other problems caused by third-party hardware or software.

8. Beta and experimental features

Some versions or features of BoxerView may be identified as beta, experimental, preview, or otherwise under development. These features may contain errors, produce unexpected results, change substantially, or stop working.

Beta or experimental features should not be relied upon for critical vehicle decisions. You acknowledge the additional risk associated with using prerelease software.

9. User data and diagnostic logs

BoxerView may allow you to create, save, view, export, or voluntarily submit diagnostic information. You remain responsible for information you choose to export, distribute, publish, or submit.

Our handling of information through BoxerView is described in the BoxerView Privacy Policy. By intentionally submitting diagnostic information to EMJAK Technologies through a feature specifically designed for that purpose, you authorize us to use that submitted information for purposes described in the Privacy Policy, including investigating compatibility, identifying ECU variants, diagnosing software problems, and improving BoxerView.

10. Acceptable use

You agree not to use BoxerView:

• In violation of applicable law.
• In a manner that creates an unreasonable risk to people or property.
• To interfere with or attempt to compromise BoxerView’s security.
• To gain unauthorized access to systems or services.
• To intentionally disrupt BoxerView or associated services.
• To misrepresent BoxerView data as guaranteed or certified diagnostic information.
• To reverse engineer, redistribute, copy, or exploit BoxerView except where permitted by applicable law or an applicable software license.

Nothing in these Terms prohibits rights that cannot legally be restricted.

11. Intellectual property

BoxerView, including its application software, original interface elements, branding, graphics, documentation, and other original materials, is owned by or licensed to EMJAK Technologies and is protected by applicable intellectual-property laws.

BoxerView and associated branding may not be used in a manner that falsely suggests sponsorship, endorsement, or affiliation with EMJAK Technologies. BoxerView may incorporate or interact with third-party or open-source materials subject to their own licenses. Those materials remain subject to their applicable licenses.

12. No affiliation with vehicle manufacturers

Unless expressly stated otherwise, BoxerView and EMJAK Technologies are independent from vehicle manufacturers and other third-party brands whose products may be compatible with BoxerView. References to vehicle manufacturers, models, ECUs, protocols, or third-party products are used for identification and compatibility purposes. All third-party trademarks remain the property of their respective owners.

13. Purchases and paid features

BoxerView may offer paid applications, upgrades, features, or services in the future. Purchases made through Apple’s App Store are also subject to Apple’s applicable payment and App Store terms. Prices and available features may change over time. Any refund rights provided by applicable law or the platform through which a purchase was made are not limited by these Terms.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOXERVIEW IS PROVIDED “AS IS” AND “AS AVAILABLE.”

EMJAK TECHNOLOGIES MAKES NO WARRANTY THAT BOXERVIEW WILL BE ERROR-FREE, UNINTERRUPTED, COMPATIBLE WITH EVERY VEHICLE OR DEVICE, OR THAT INFORMATION PROVIDED BY BOXERVIEW WILL BE COMPLETE OR ACCURATE.

WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED. Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

15. Assumption of risk

You understand that working with, diagnosing, modifying, testing, or operating motor vehicles involves inherent risks. You voluntarily assume the risks associated with your use of BoxerView and with actions you choose to take based upon information obtained through BoxerView.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMJAK TECHNOLOGIES LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF BOXERVIEW.

This includes, to the extent permitted by law, loss of data, loss of use, loss of profits, towing costs, vehicle downtime, or damage resulting from decisions made in reliance on information provided by BoxerView.

To the maximum extent permitted by applicable law, EMJAK Technologies’ total liability arising out of or relating to BoxerView will not exceed the greater of: (A) the amount you paid for BoxerView during the 12 months before the event giving rise to the claim; or (B) $100 USD.

The limitations in these Terms do not apply where applicable law prohibits such limitations, including liability that cannot legally be waived or limited.

17. Changes to BoxerView

BoxerView is actively developed. We may add, remove, modify, restrict, or discontinue features, supported vehicles, parameters, adapters, or other functionality. We do not guarantee that a particular feature or compatibility configuration will remain available indefinitely.

18. Suspension or termination

We may restrict or terminate access to BoxerView or associated online services when reasonably necessary to protect BoxerView, our users, our systems, or third parties, or when these Terms are materially violated. You may stop using BoxerView at any time.

Sections of these Terms that by their nature should survive termination—including intellectual-property provisions, warranty disclaimers, assumption of risk, and limitations of liability—will survive.

19. Privacy

Your use of BoxerView is also subject to the BoxerView Privacy Policy, which explains how BoxerView handles vehicle information and other data.

20. Changes to these Terms

We may update these Terms as BoxerView develops, our business practices change, or legal requirements change. The current version will identify its effective or “Last updated” date.

If a change materially affects your rights or obligations, we may provide additional notice where appropriate. Continued use of BoxerView after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

21. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Nothing in these Terms deprives you of consumer protections or other rights that cannot be waived under applicable law.

22. Entire agreement

These Terms, together with the BoxerView Privacy Policy and any additional terms presented for a particular feature or purchase, constitute the agreement between you and EMJAK Technologies regarding your use of BoxerView.

If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
